Marriage After Divorce
What divorced people usually need before getting married again, including when the divorce must be final and what documents are required.
Yes, you can get married if you are divorced, but your earlier marriage must be legally ended before the new marriage can be solemnised.
The practical rule
You can often start planning early and even lodge the NOIM, but before the new marriage happens you must be able to show the correct divorce document.
If your divorce is still pending
You may be able to:
- lodge the NOIM
- gather the rest of your documents
- plan a ceremony date that is safely after the divorce becomes final
But you cannot proceed with the marriage itself until the earlier marriage is legally over.
What you usually need
- your divorce order or equivalent evidence
- translations if the divorce document is not in English
